Terms of Service

Welcome to Swapify. These Terms of Service (the “Terms”) are an agreement between you and Swapify and cover your use of our website, web app, and related services that let you turn a selfie into AI-generated photos and videos (together, the “Service”). Please read them carefully — by using Swapify you agree to everything below.

1. Acceptance of these Terms

By creating an account, generating content, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Content & Acceptable Use Policy. If you do not agree, please do not use Swapify.

2. Eligibility

You must be at least 13 years old to use Swapify. If you are between 13 and the age of legal majority in your country, you may only use the Service with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. By using the Service you represent that you meet these requirements and that you are not barred from using it under any applicable law.

3. Your account

• You are responsible for the information you provide and for keeping your login credentials secure.
• You are responsible for all activity that happens under your account, whether or not you authorized it.
• Notify us promptly at support@swapify.link if you suspect unauthorized access.
• One person should not maintain multiple accounts to abuse free credits, promotions, or trials.

4. Credits and subscriptions

Swapify runs on credits. Each generation spends credits depending on the output type — for example, a photo generation costs fewer credits than a video. Credits can be included with a plan, purchased as one-time packs, or granted through promotions.

• Subscriptions auto-renew. Paid plans renew automatically at the end of each billing period (monthly or annual) at the then-current price until you cancel.
• Cancellation. You can cancel anytime from your billing settings. Cancellation stops future renewals; you keep access through the end of the period you already paid for.
• Credit expiry. Plan credits may reset each cycle and do not always roll over. Purchased credit packs and their expiry terms are described at checkout.
• Pricing changes. We may change prices or plan features. We will give reasonable notice of changes that affect an active subscription before they take effect on your next renewal.
• Refunds. Except where required by law, payments and consumed credits are non-refundable. If something goes wrong on our side, contact support and we will try to make it right.

5. Acceptable use

You agree to use Swapify lawfully and respectfully. You will not misuse the Service, interfere with its operation, attempt to reverse engineer or scrape it, bypass usage limits or security, or use it to build a competing model or dataset. Detailed rules about what you can and cannot create are in our Content & Acceptable Use Policy, which is part of these Terms.

6. Your content and the license you grant us

“Your Content” means the photos, prompts, and other materials you upload or submit. You keep ownership of Your Content. To run the Service, you grant Swapify a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process Your Content for the purpose of operating, securing, and improving the Service and generating your outputs. This license exists only so we can provide the Service to you and ends when Your Content is deleted from our systems, except for copies retained briefly in backups or as required by law.

You represent that you have the rights and any necessary consents to upload Your Content — including the consent of any identifiable person who appears in it.

7. Ownership of outputs

Subject to your compliance with these Terms and payment of any applicable fees, you own the AI-generated images and videos you create with Swapify (“Outputs”), to the extent such ownership is possible under applicable law. Note that AI-generated material may have limited or unclear copyright protection in some jurisdictions, and similar Outputs may be produced for other users from similar inputs. Commercial use of Outputs is governed by Section 9.

8. Prohibited content

You must never use Swapify to create, upload, or share:

• Imagery using a real person’s likeness without that person’s consent, including non-consensual intimate or sexual imagery.
• Any sexual or exploitative content involving minors — we have zero tolerance and report such material to the appropriate authorities.
• Content created to impersonate, defraud, defame, harass, or mislead others, including deceptive deepfakes.
• Content that infringes intellectual property, privacy, or publicity rights, or that is illegal, hateful, or incites violence.

9. Commercial use

Personal plans are for personal, non-commercial use. A commercial-use license for Outputs is available with the Studio plan. Review your plan to confirm whether commercial use is included before using Outputs in advertising, products, or other commercial contexts.

10. AI disclaimer

Swapify uses generative AI. Outputs are produced automatically and may be inaccurate, unexpected, unflattering, or fail to match your intent. Outputs are not real photographs and should not be presented as factual depictions of real events. You are responsible for reviewing Outputs before you publish or share them.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or create risk or legal exposure for us or others. We may also discontinue features or the Service with reasonable notice. On termination, your right to use the Service ends; sections that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will continue to apply.

12. Disclaimers and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Swapify will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws applicable at Swapify’s principal place of business, without regard to conflict-of-law rules. The specific jurisdiction and any dispute-resolution process should be finalized with your attorney before launch.
