Content & Acceptable Use Policy

This Content & Acceptable Use Policy explains what you may and may not create with Swapify. It applies to the Swapify mobile applications and to the Swapify web applications at portal.swapify.link and web.swapify.link, and it is part of our Terms of Service (in particular Sections 6, 7 and 16). References to "Swapify", "we", "our" or "us" are to Swapify Inc.
1. Who can use Swapify
a. Swapify is intended for users who are at least 18 years old.
b. You must not upload photos of minors (individuals under 18) or generate content featuring the faces or likenesses of minors, in any context. Any violation of this rule results in immediate suspension or termination of the account.
2. Consent and likeness
a. Only upload photos of yourself or of people who have given you affirmative, informed and voluntary consent to: (i) the upload of their photos to Swapify; (ii) the use of their likeness in AI-generated or altered content; and (iii) the publication, sharing or distribution of the result.
b. You must be able to provide proof of such consent upon our request.
c. Do not use Swapify to impersonate a real person in a way that could deceive others, damage their reputation or cause them harm.
3. Prohibited content
You must not upload, create, generate or share with Swapify content that:
a. depicts a person in an intimate, sexual or nude context without their consent, including "deepfakes" and other digital forgeries;
b. exploits, sexualises or otherwise harms minors in any way;
c. is unlawful, obscene, pornographic, defamatory, threatening, harassing, hateful or abusive, or promotes violence, racism or discrimination against any group or individual;
d. is false or misleading and intended to harm others, including fabricated statements or events attributed to real people;
e. encourages criminal activity or provides instructions for illegal activities;
f. infringes anyone's copyright, trademark, rights of publicity, privacy or other rights; or
g. reveals personal information that can be used to identify, locate or harm a person without their consent.
4. AI labels
Content created with Swapify may be marked as AI-generated — with a visible watermark, a label or embedded metadata. You must not remove, hide or alter these markings, and you must not present AI-generated content as a real recording of events.
5. How we enforce this Policy
a. We use automated systems and manual review to detect content that violates this Policy. Generated results that appear to violate it may be blurred, blocked or removed.
b. Depending on the severity and repetition of violations, we may limit the features available to you, delay or restrict generations, temporarily suspend your account, or terminate your access to Swapify, including paid features, as described in Section 7 of the Terms of Service.
c. We may preserve information and cooperate with law enforcement authorities where required by law or to prevent harm.
6. Reporting and appeals
a. To report content created with Swapify that violates this Policy, including content that uses your likeness without your consent, email support@swapify.link with a link to or a copy of the content and a short description of the issue.
b. If you believe that we blurred or removed your content, or restricted your account, by mistake, contact us at support@swapify.link and we will review the decision. Users located in the European Union will receive a statement of reasons for our decision and may request its review under the EU Digital Services Act.
7. Copyright infringement (DMCA)
a. We respect the intellectual property rights of others and expect our users to do the same. In appropriate circumstances and at our discretion, we disable or terminate the accounts of users who repeatedly infringe the copyrights or other intellectual property rights of others.
b. If you are a copyright owner, or are authorised to act on behalf of one, you may report an alleged infringement by sending our Designated Copyright Agent a notice that includes:
i. the copyrighted work that you claim has been infringed, or a representative list if the notice covers several works;
ii. the material that you claim is infringing and information reasonably sufficient to locate it, such as its URL;
iii. your mailing address, telephone number and, if available, email address;
iv. a statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent or the law;
v. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner, or authorised to act on behalf of the owner, of the right that is allegedly infringed; and
vi. your full legal name and your physical or electronic signature.

8. Changes to this Policy
We may update this Policy from time to time. The date of the latest update is shown at the top of this page. If a change is material, we will notify you in advance, for example by email or in the Swapify applications.
